problems police had with the new year's crowd and has the latest. >> reporter: good morning. happy new year. san francisco police had their hands full because some celebrations did not go as planned. there were two separate shootings last night. now three people are recovering from gunshot wounds. the first one happened around 10:40. a victim was shot in the hand near jefferson and mason near fisherman's wharf. the second shooting happened less than an hour later on the embarcadero past peer 23. a 12-year-old boy was shot in the foot and a man suffered a graze wound to the hip. police have not arrested any suspects in either shooting. >> there's a month of design that we do actually working on the computer designing how we want -- when we want the shells to go off, there is a sound track that will be broadcast on the embarcadero. >> as you can hear not all celebrations went wrong. this was great here. aside from those incidents, san francisco still well comedy

2013 with bright lights, about 5,000 fireworks, tens of thousands of partiers coming out to watch the well-lit 15- minute show. police also though aside from that did make a handful of arrests. some people took their parties too far. eight people were arrested for public intoxication and two for misdemeanor. live in san francisco, cate caugiran, cbs 5. two people are dead and through injured after a the shooting in the old sacramento area. about 40,000 people were gathered for a fireworks show when shots rang out on second street. police say there was a fight at a cafe just before the shooting. >> at first when i heard the bullets, everybody was running into the stores to hide and i immediately went out because i wanted to see what the action was. and then i seen the officer jump off has horse. the horse kept going. and the officer just did not

have no fear. he just took that guy down. >> mayor kevin johnson says there's no indication of any outstanding suspects and police canceled a midnight fireworks show because of it. 4:35 now. here's a check of some of the holiday closures here in the bay area. most federal, state, county and city offices closed new years day including the post office and there is no mail delivery today. banks are closed. and here in san francisco, you don't have to feed the meters. >> considering how many people are out they may as well be closed. >> it's crazy. thousands of people have been waiting in the cold down in pasadena as well to secure a good spot -- [ laughter ] >> are you okay? >> that chair is so tricky, frank. easy ride on the northbound side from 85 to 101. we'll get a live look at conditions along 101 in the south bay in a few minutes. back to you. >> thank you. a major dismantling of some marijuana operations in remote areas of santa clara county. sheriff's deputies dangled on a 100-foot rope suspended from a helicopter and dropped into eight separate locations. a little help from the state fish & game wardens, they cleared more than four tons of material including irrigation tubing, gardening equipment and a honda muffler that may have been used on a generator. 4:38 now. contra costa county is operating with four fewer fire stations this morning. contra costa supervisors voted unanimously last month to close four stations in clayton, lafayette, martinez and walnut creek. this move is expected to save the district up to $8 million a year. on january 10, fire officials will meet with martinez residents to talk about the

their closure. in other bay area headlines, a noontime vigil is planned in oakland today for a man who was shot and killed while detained by bart police. family will hold a vigil at the fruitvale bart station. that's where oscar grant was shot four years ago today. officer johannes mehserle was later found guilty of involuntary manslaughter. he was released from prison in june 2011 after serving his sentence. the reward is now up to $15,000. this is for information leading to an arrest in the shooting death of a 15-year-old girl in east oakland. investigators say that jubrille jordan was shot sunday at 66th avenue and lion way as she and a 14-year-old boy were walking to a bart station. the boy was wounded in the foot. an exciting end to 2012 at mineta international airport in san jose. a man hopped a fence and took off across the tarmac. this all happened around 8:00 last night. the man apparently made it

everything looking good through the altamont pass westbound 580. 14 minutes altamont pass to 680. once you hit 680 they brake lights to report. traffic is clear at the dublin interchange. 680 itself also looking good. now, mass transit is on time. bart though is on a holiday schedule as well as most of mass transit. so make sure you check the websites before you head out. looks like bart won't resume at least for another hour but they did run late trains last night for new year's eve. caltrain, ferries, everything on a holiday or sunday schedule so heads up out the door. >> that one car on the road was probably the last person to leave the party. secretary of state hillary clinton is expected to make a full recovery after she was diagnosed with a blood clot. she is being treated at new york-presbyterian hospital where doctors hope that blood thinners will dissolve the clot. they say it is between her brain and skull right behind her right ear.

>> we know that two to three weeks ago, she fainted and hit her head. at that time, she could have had trauma. she could have ripped that vein and had a little bleeding and clot formation. on top of that, we were told she had a stomach virus and we know that doe hydration increases the odds of having a clot. >> doctors treating secretary clinton say that the clot has not caused a stroke or any kind of neurological damage. they did say that she will be released from the hospital once the medication dosed for the blood thinners has been established. 4:47. there is a sudden surge of marriages in maryland this new year's day. same-sex couples can now legally wed in that state. city halls in baltimore and some of the other industries were open at midnight for couples who didn't want to wait. maryland is the ninth u.s. state where same-sex marriage is now legal. marijuana clubs are starting to pop up in the state of colorado. at least two have opened less than a month after governor john hickenlooper signed into

law a constitutional amendment allowing recreational pot use in the state. one club says 200 people have already signed up, paid the $30 admission fee. they have to bring their own stash. the club's attorney says as long as marijuana is not sold there, it will be legal in that state. america's major stock markets did a lot better in 2012 than they did the year before. now, the dow finished the year with a 7% gain. it added 5.5% in 2011. the nasdaq did better. it rose 16% in 2012. that followed a nearly 2% loss in 2011. the markets are closed today for the new year's holiday. sales tax in california is higher this morning than it was yesterday. the tax increased by .25% because of prop 30 that was passed by voters in november. the initiative, pushed by the governor, increased sales tax rates to 7.5%. that works out to be 1-cent for every four dollars you spend.

>> even if it's one penny, it's five cents, it's going to add up because -- i'm only 21 and i spend money like it's nothing. >> so local governments have even higher taxes and the bay area taxes in el cerrito and union city are now at 9.5%. there are also a number of new laws set to go into effect today. drivers in california can now text and email while driving if they use a voice-operated system. other laws restrict banks from pursuing so-called dual track foreclosures. and there are also several measures designed to ensure the safety of natural gas pipeline. but there's one contested measure that's still on hold a ban on gay conversion therapy. it will not go into effect because of a federal appeals court issuing a stay. chp out in force last night looking for anyone who shouldn't be on the roads and here's a sobering thought. a dui can cost you up to

$7,000. cbs reporter mark strassmann shows how some new technology could put the brakes on drunk driving. reporter: >> so we want to take this device and implement it in the car. >> reporter: bud is leading a team creating technology that might prevent 10,000 drunk driving deaths a year. unlike this existing breathalyzer test for convicted drunk drivers, these two new sensors would test anyone behind the wheel. >> the injured to develop a sensor that can be -- the idea is to develop a sensor that can be able to prevent anybody above the legal limit from moving the vehicle and driving. >> reporter: the touch-based sensor in the start stop button shines an infrared light into the driver's finger. in a half second, it measures the alcohol content in the tissue. the second type of technology is a breath-based sensor mounted near the steering wheel that would measure molecules in a driver's breath. how far away is this technology from being ready? >> eight to 10 years when you
